Dive RED - Terms of Service

1. Introduction & Acceptance of Terms
Welcome to Dive RED! We are a collective of independent, certified diving instructors providing private and personalized diving experiences in the Hurghada and Makadi Bay areas of the Red Sea, Egypt.
These Terms of Service ("Terms") govern your use of the diving services offered by Dive RED and its affiliated instructors ("we", "us", "our"). By booking or participating in any diving activity arranged through Dive RED, you ("you", "the client", "the diver") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not book or participate in our services.
2. Description of Services
Dive RED specializes in providing private diving instruction, guided dives, and related dive experiences. Our team comprises instructors certified by internationally recognized training organizations, including PADI, SSI, SDI, and ISC. We cater to various skill levels, from beginners to experienced divers, subject to prerequisite certifications and experience where applicable.
3. Operational Model & Flexibility
* Network-Based Operation: Please note that Dive RED does not operate from a single, fixed physical dive center. We function as a network of private instructors.
* Use of Third-Party Facilities: To provide maximum flexibility in scheduling and dive site access, we utilize facilities (diving boats, shore entry points, classroom facilities where applicable) operated by various established dive centers and boat operators throughout Hurghada and Makadi Bay.
* Contractual Arrangements: We maintain contractual agreements with these third-party providers to secure spots and ensure access to necessary resources for our clients' dives.
* Meeting Points: Specific meeting points for dives or courses will be communicated clearly during the booking process. These may vary depending on the dive plan, boat availability, and client location.
* Flexibility: This operational model allows us to offer highly flexible dive planning tailored to your preferences and schedule, leveraging the best available resources on any given day.
4. Instructor Qualifications & Standards
All instructors affiliated with Dive RED are independent professionals who are certified and in active teaching status with one or more recognized diving agencies (such as PADI, SSI, SDI, ISC). They adhere to the safety standards and procedures mandated by their respective certifying organizations and follow the general safety guidelines set forth by the World Recreational Scuba Training Council (WRSTC) and the Recreational Scuba Training Council (RSTC).
5. Booking & Payment
* Booking: Bookings can be made via email at info@dive-red.com or WhatsApp at +20 109 695 6474. Availability is subject to instructor schedules and third-party facility capacity.
* Confirmation: Your booking is confirmed upon receipt of the agreed deposit or full payment, and you receive a written confirmation from Dive RED (via email or WhatsApp).
* Payment: Full payment is required at least 48 hours prior to the scheduled activity, or as specifically agreed upon during the booking process. We accept payment via PayPal or Cash Deposit (details provided during booking). Any transaction fees (e.g., PayPal fees, bank fees) are the responsibility of the client.
* Pricing: Prices will be quoted during the booking inquiry and are subject to change until the booking is confirmed.
* Included: Prices typically include: Services of a certified Professional Dive Instructor/Guide, Full Scuba Equipment Rental (BCD, regulator, wetsuit, mask, snorkel, fins, weights & belts, tanks - 12L Aluminium unless otherwise specified), standard Dive Site access fees, and lunch & soft drinks (typically provided on boat trips, confirm specifics during booking).
* Excluded: Prices typically exclude: Transportation to/from the designated meeting point or jetty (unless specifically arranged and quoted), National Park / Marine Park entrance fees (payable directly where applicable, will be advised during booking), Dive Computer rental (available at extra charge), underwater camera rental, personal expenses (e.g., souvenirs, crew tips), and individual dive accident insurance (recommended).
6. Diver Responsibilities & Requirements
* Mandatory Documentation (Legal Requirement): In accordanceance with Egyptian law and regulations governing diving activities, ALL clients MUST provide a clear copy of their valid passport identification page prior to any diving activity. Certified divers MUST also provide a clear copy of their valid diving certification card(s). Failure to provide these mandatory documents will prevent participation in any diving activities, and services will be considered forfeit without refund. This is a strict legal requirement for all diving operators in Egypt.
* Certification: Certified divers must present valid proof of certification (original card or verifiable eCard) before any dive, in addition to the copy submitted beforehand. Divers are responsible for diving within the limits of their certification and experience unless under direct training supervision.
* Medical Fitness: Diving requires a good level of physical and mental fitness. You are responsible for ensuring you are medically fit to dive. You will be required to complete a standard Medical Statement form prior to diving. If you answer "YES" to any condition on the medical form, you MUST provide written clearance from a physician certifying your fitness to dive before participating in any in-water activities. Failure to provide this clearance when required will result in cancellation of your dives without refund.
* Liability Release & Assumption of Risk: All participants must read and sign a Liability Release and Assumption of Risk waiver before participating in any in-water activity. Diving involves inherent risks, and you participate at your own risk.
* Conduct: Divers are expected to follow instructor briefings and directions, adhere to safe diving practices, respect the marine environment (no touching or taking marine life), and behave respectfully towards instructors, crew, and other divers. We reserve the right to refuse service or terminate a dive/trip without refund for any diver who appears intoxicated, under the influence of drugs, fails to follow safety procedures, or behaves disruptively or disrespectfully.
* Equipment: Divers using their own equipment are responsible for ensuring it is in good working order and has been serviced according to manufacturer recommendations. Rented equipment must be treated with care. Lost or damaged rental equipment will be charged to the client at replacement cost.
7. Liability Limitation & Insurance
While Dive RED and its affiliated instructors adhere to recognized safety standards (WRSTC, RSTC) and use appropriately vetted third-party facilities, participation in scuba diving involves inherent risks that can lead to injury, illness, death, or property damage. By agreeing to these Terms, you acknowledge these risks and agree that Dive RED, its owners, affiliated instructors, and partner facilities/boat operators shall not be held liable for any loss, injury, death, or damage arising from participation in diving activities, except in cases of proven gross negligence or willful misconduct directly attributable to us or our instructors acting within the scope of their duties. This limitation applies to the maximum extent permitted by Egyptian law. For added peace of mind, Dive RED maintains diving operations insurance through the Divers Alert Network (DAN). This insurance covers our operations but does not replace the need for individual divers to consider their own dive accident insurance.
8. Third-Party Services
While we contract with specific boats and dive centers, these are independent entities. Dive RED acts as an agent in arranging these services but is not responsible for the specific operations, staff conduct (beyond our own instructors), or maintenance standards of these third-party providers. We strive to work with reputable partners but cannot assume liability for their independent actions or omissions.
9. Changes to Terms
Dive RED reserves the right to modify these Terms at any time. Updated Terms will be effective upon being provided during booking confirmation or via email. Continued use of our services after changes constitutes acceptance of the new Terms.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordanceance with the laws of the Arab Republic of Egypt. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hurghada, Egypt.
